This study draws on a synergy of Corpus Linguistics and Critical Discourse Studies to scrutinize the portrayal of hackers in China Daily and The New York Times in the 21st century, primarily revolving around the main social actors and targets in hacking. This study demonstrates that both media share a positive transformation of the image-building of hackers in the 21st century. Besides, countries are salient social actors in hacker media discourse and the two media differ in their ways of constructing (...) them. The New York Times tends to have a negative other-representation and categorical otherness of specific countries through such discursive strategies as negative other-representation and group categorization, whereas China Daily is prone to insist on opposing the US hacking allegations in a defensive manner. Regarding major targets, China Daily highlights government websites whereas The New York Times emphasizes government websites, officials’ emails, large technology companies, and election infrastructure. The analysis shows that the two media’s different ways of framing hackers are underpinned by the ideologies behind them and the Chinese and US socio-political landscapes. This study can provide insights into how hacker discourse in media is represented in the 21st century and how national identities are constructed in the media representations of hackers. (shrink)

This study investigates some cases related to the interpretation of law in Right of Abode cases heard by the Court of Final Appeal of Hong Kong, and discusses the sharp contrast between the different versions of interpretation of the same legislative expressions as the same signs in similar cases heard by the same court. This study does not aim to find out the legislative intent of legislation, but to investigate the process of meaning-making in general and the intent seeking in (...) these cases in particular from a socio-semiotic perspective. The study concludes that meaning-making in legal settings is neither purely a jurisprudential operation nor the choice among different canons of legal interpretation. It is rather the dialogue demonstrated in various forms, such as power negotiation and interest weighing. The study, therefore, argues that legal interpretation is a social practice and meaning-making in legal settings is an enterprise of social dialogue and power negotiation; in other words, legal interpretation is in a sense an inter-semiotic operation between law and its interfaces with society and politics. By exploring the cultural discrepancies in Chinese legal texts and their English versions and to what extent legal and cultural discrepancies influence and constrain legal translation, the study argues that it is useful to consider cultural discrepancies within a semiotic framework. Language is a phenomenon and factor that links different cultures; the use of language is crucial to any legal system. Law, as a cultural product, is attended by cultural discrepancies when switched into other languages for the purpose of achieving (...) equivalence. After a brief overview of cultural differences in translation, legal translation in particular, the study is set to examine the role of translation in crossing through different legal cultures and backgrounds and investigate barriers in the process of translation. Investigating cultural discrepancies in legal translation within a semiotic framework allows us to focus on certain interpretations by acknowledging that legal texts are composed with systems of systems and interacting with other cultural aspects in a wider context. Although legal terms are conventionally considered to have self-referential, self-closed meaning independent of context, a legal term only acquires its meaning within a given context. As long as the context varies, the meaning of the same legal term as a signifier may change correspondingly. Based on case studies by applying semiotics, we argue that a legal term is just a sign within its sign system; a legal term as an individual sign does not have any inherent meaning, and its meaning (...) can only exist in the relationship with other signs or sign systems. In other words, a legal term only denotes in a particular temporal and spatial context. Through this study, we conclude four propositions about a legal term as a sign: first, the connection of a legal term with a legal concept is relatively arbitrary; second, the meaning of a legal term exists in a sign system; third, a legal term can be subject to multiple interpretations; fourth, the defining of a legal term may be affected by other sign systems. Among the categories of the telecom and internet frauds, the online romance scam is of particular concern for its sharp rise of victim numbers and the huge amount of cost. A social semiotic approach could be used to investigate the victim identity of the online romance scam from the aspects of the (re)construction and interpretation of discursive practices. The range of papers in this section shows that the study of text, context and the way that people use semiotic resources to (...) produce communication, to create and manage events and to interpret them. ABSTRACT In this paper we explore how a public national media outlet, the British BBC, represents an international legal case which has a highly political nature. The case is US versus Huawei/meng Wanzhou, which took place between 2018 and 2021. Accusations were that the Chinese technology company committed fraud, leading the global HSBC bank to breach US sanctions against Iran. The charges were made by the US using what is called an ‘extraterritorial law’, which, while rejected as law by governments (...) around the world, is policed by US economic powers and control over international finance. Using Critical Discourse Analysis we show that, while the BBC presents much detail of legal process, the actual nature of the law the US uses to bring criminal charges against international companies and banks, is neither considered nor questioned. Our interest is how such a law, which has a huge influence over global trade and politics, is presented to the public in this particular case. We contribute to the position that the nature of laws, how they are used and known, must always be understood within the prevailing discourses of the moment. (shrink)

Genre has been a critical issue in discourse analysis as well as in other disciplines. Based on a literature review of the concept of genre and taking judgments as one type of genre in legal settings, the present study provides a corpus-based insight into the nature of genre. The literature review per se reveals that genre has one typical feature of a sign, that is, being subject to multiple and alternative interpretations; in other words, genre as a sign may have (...) various interpretants. The present study unravels the actual generic structures, distinguishes different types of generic structures within the given genre, and then defines the dominant generic structure of judgments in Hong Kong, Taiwan, and Mainland China. This study also examines and contrasts the generic structure potential of judgments in each jurisdiction. In addition, the variation of Mainland China's judgments over time is briefly discussed. Comparing the generic structures of judgments among the three jurisdictions, as well as the structures of judgments in Mainland China over time, the paper argues that genre also has the essential features of a sign, that is, the characteristics of temporality and spatiality. Law as one sign system can be recorded and interpreted by another sign system—media. If each transaction in court is taken as a sign, it can be interpreted or transferred by different signs of media for the same purpose, though with different effects. This study focuses on the transformative effects of the semiotic revolution in media on law. The present research revealed that the evolution of media has driven the administration of justice to pay more attention to the process of (...) court proceedings. This research also discusses the semiotic conflict and compatibility between the sign subsystems within media upon interpreting the administration of justice. In addition, disequilibrium between different sign systems highlights the consequent need for intersemiotic translation, consciousness and evaluation as part of decision making on court domains. Enfin, une telle conception de l’humain est-elle en droit d’être au fondement d’un humanisme confucéen et d’une universalité chinoise? In patent prosecution, timely and effective responses to Office Actions (OAs) are crucial for securing patents. However, past automation and artificial intelligence research have largely overlooked this aspect. To bridge this gap, our study introduces the Patent Office Action Response Intelligence System (PARIS) and its advanced version, the Large Language Model (LLM) Enhanced PARIS (LE-PARIS). These systems are designed to enhance the efficiency of patent attorneys in handling OA responses through collaboration with AI. The systems’ key features include the construction (...) of an OA Topics Database, development of Response Templates, and implementation of Recommender Systems and LLM-based Response Generation. To validate the effectiveness of the systems, we have employed a multi-paradigm analysis using the USPTO Office Action database and longitudinal data based on attorney interactions with our systems over six years. Through five studies, we have examined the constructiveness of OA topics (studies 1 and 2) using topic modeling and our proposed Delphi process, the efficacy of our proposed hybrid LLM-based recommender system tailored for OA responses (study 3), the quality of generated responses (study 4), and the systems’ practical value in real-world scenarios through user studies (study 5). The results indicate that both PARIS and LE-PARIS significantly achieve key metrics and have a positive impact on attorney performance. (shrink)

Par la grâce d'un autre dandy, Jules Barbey d'Aurevilly, qui publie Du dandysme ou de George Brummell, et de Charles Baudelaire. Certains se souviennent d'un auteur de la fin du siècle dernier qui s'était rendu célèbre par ses extravagances vestimentaires : son pourpoint Renaissance et sa barbe à l'assyrienne dans le Paris de la Belle Epoque défrayait la chronique. Les journalistes ont aussi consacré une large place à ses démêlés avec d'autres occultistes. Ses salons (...) de la Rose-Croix, pour lesquels Satie composa des sonneries, eurent une grande renommée et sont importants pour qui s'intéresse à l'histoire de l'art. Péladan, avec un sens certain de la publicité, s'était proclamé S.A.R., titre assyrien qui en faisait un descendant mythique des Mages chaldéens. C'est ce titre qui a assuré sa notoriété jusqu'à nos jours. D'androgynes pervers en femmes violées, mêlant la magie aux thèmes décadents, ses romans présentent un tableau étonnant de la pensée fin de siècle. Ce texte veut démontrer que Joséphin Péladan, qui eut des admirateurs comme Jarry ou Paul Valéry, n'était pas qu'un dandy excentrique, un farfelu 1900 teinté d'ésotérisme mais un authentique écrivain. Il existe un récit de Borgès qui raconte l'histoire d'un peintre qui voulut faire un tableau de l'univers. Au bout de nombreuses années de travail, il avait peint un mur entier de personnages pour s'apercevoir qu'en fait il n'avait peint que son propre visage. Ce fut précisément la destinée de Péladan : l'auteur ne fit plus qu'un avec son personnage principal du Mage. Jamais son œuvre n'aura présenté une telle fusion entre imaginaire et réalité. (shrink)

Would it be possible to have an alternative to the physicalist world-view? If any type of dualism is not an option, I am tempted to consider an integrational world view, which was first claimed by Confucius under the notion of cheng. I would propose an integrational thesis that cheng of an entity is a power to realize the embedded objective of it in the context where it interacts with all others. The notion of compassion may be said to be both (...) dispositional and mental. Then, this notion is one candidate to shed lights on the integrational thesis. The thesis doesn't exclude roles the causal notion has to play in the integrational system. Rather it allows the causal notion in its proper place, not having to exclude other relational notions in the system. What it denies is that the causal relation is all there is among what is there. The notion of compassion is essentialist in two senses. The first is the sense in which Mencius said that compassion is necessary for one to be a human. The second is the sense that compassion is an essentialist disposition. "Compassion" does neither refer to a mental state nor reflect a human relation, but it denotes an abstract property, or a theoretical notion, which can be singled out by a Ramsey sentence. There are many challenges for the integrational thesis to meet. Some of them are how the integrational thesis could allow an essentialism of a kind?, Is there a way for the integrational view of language to meet the requirements of modal semantics?, and so on. The present paper may not able to explain all of these questions but it will try to suggest how to approach toward the task. (shrink)

The concept of rectifying names [cheng-ming] is a familiar one in the Confucian Analects. It occupies an important, if not central, position in the political philosophy of Confucius. Since, according to Confucius, the rectification of names is the basis of the establishment of social harmony and political order, one might suspect that later political theories of Confucian-ists should be traced back to the Confucian doctrine of rectifying names. It need not be added that the theory of rectifying names, as developed (...) by Hsün Tzu in the third century B. C., served the double purpose of strengthening his political doctrine of government on the one hand and repudiating doctrines of names on the other. (shrink)

A fuzzy predictive fault-tolerant control scheme is proposed for a wide class of discrete-time nonlinear systems with uncertainties, interval time-varying delays, and partial actuator failures as well as unknown disturbances, in which the main opinions focus on the relevant theory of FPFTC based on Takagi-Sugeno fuzzy model description of these systems. The T-S fuzzy model represents the discrete-time nonlinear system in the form of the discrete uncertain time-varying delay state space, which is firstly constructed by a set of local linear (...) models and the nonlinear membership functions. The novel improved state space model can be further obtained by extending the output tracking error to the constructed model. Then the fuzzy predictive fault-tolerant control law based on this extended model is designed, which can increase more control degrees of freedom. Utilizing Lyapunov-Krasovskill theory, less conservative delay-range-dependent stable conditions in terms of linear matrix inequality constraints are given to ensure the asymptotically robust stability of closed-loop system. Meanwhile, the optimized cost function and H-infinity performance index are introduced to the stable conditions to guarantee the robust performance and antidisturbance capability. The simulation results on the temperature control of a strong nonlinear continuous stirred tank reactor show that the proposed control scheme is feasible and effective. (shrink)
